LEGAL INFORMATION ABOUT THE CHAMBER

The Official Chamber of Commerce, Industry, Services and Navigation of Barcelona (from now on “the Chamber”) is a public law corporation governed by Law 4/2014, of April 1, basic of the chambers officials of commerce, industry, services and navigation and Law 14/2002, of 27 June, of the official chambers of commerce, industry, services and navigation of Catalonia and the General Council of Chambers.

USER ACCEPTANCE

The purpose of this document (hereinafter referred to as "Legal Notice") is to regulate the use of the different websites owned by the Chamber under different domain names (for example http://www.cambrabcn.org, www.consultescambra.cat, www.consolatdemar.org...), and of those who are under their responsibility (for example www.llotjavirtual.cambrabcn.org) and which will be redirected to this Legal Notice.

Anyone who accesses this website and uses its services, or provides their data, assumes the role of user, committing to the strict observance and compliance of the provisions contained herein, as well as any other provision law that was applicable.

The acceptance of this document implies that the user:

a) You have read and understand this Legal Notice.

b) That assumes, and accepts, all the obligations set out therein.

This Legal Notice will have an indefinite period of validity or, in any case, will be valid until it is modified.

The lender reserves the right to modify any type of information that may appear on the website, without any obligation to notify or inform users of the aforementioned modifications, with the publication on the website of the lender

CORRECT USE OF THE WEB

The user undertakes to use the website, the contents and the services in accordance with the Law, this Legal Notice, good customs and public order. In the same way, the user undertakes not to use the website or the services provided through it for purposes or effects that are illegal or contrary to the content of this Legal Notice, that harm the interests or rights of third parties, or that in any way may damage, disable or deteriorate the website or its services or prevent satisfactory use of the website by other users.

Likewise, the user expressly undertakes not to destroy, alter, render useless or, in any other way, damage the data, programs or electronic and other documents found on the website.

The user undertakes not to obstruct the access of other users to the access service through the massive consumption of the computer resources through which the Chamber provides the service, as well as not to carry out actions that damage, interrupt or generate errors in the mentioned systems.

The user undertakes not to introduce programs, viruses, macro instructions, mini-applications (applets), ActiveX-type controls or any other logical device or sequence of characters that cause or may cause any type of alteration in the computer systems of the Chamber or third parties.

The user undertakes not to misuse information, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any type of material accessible through the web or services that offers

It is not allowed, except in the cases in which the Chamber expressly authorizes it, to establish links from third-party portals or websites, to web pages of the Chamber, other than the main page of its portal, accessible at the URL address http://www.cambrabcn.org, or the one that replaces it in the future; neither is it allowed to present the web pages of the Chamber or the information they contain under frames, distinctive signs, brands or social or commercial names of another person, company or entity.

INTELLECTUAL AND INDUSTRIAL PROPERTY

This website and all its contents, including texts, documents, photographs, drawings, graphic representations, databases, computer programs, as well as logos, brands, trade names and other distinctive signs, they are the property of the Chamber or of third parties who have authorized their use.

The website, including, but not limited to, its programming, editing, compilation and other elements necessary for its operation, the designs, logos, photographs, text and/or graphics, are the property of the Chamber or, where appropriate, has a license or express authorization from the authors. All the contents of the website are duly protected by intellectual and/or industrial property regulations.

Regardless of the purpose for which the aforementioned contents were intended, their total or partial reproduction, use, exploitation, distribution and commercialization, requires, in any case, prior written authorization by the Chamber. Any use not previously authorized by the Chamber will be considered a serious breach of the author's intellectual or industrial property rights, as well as the right to privacy and the self-image of the people who may appear there.

The designs, logos, text, photographs and/or graphics, which do not belong to the Chamber and which may appear on the website, belong to their respective owners, being themselves responsible for any possible controversy that may arise in this regard. In any case, the Chamber has express and prior authorization from the authors for its publication.

The user and/or visitor of the website undertakes to respect these rights and, consequently, not to copy, reproduce, modify, distribute, transmit, publish, exhibit or represent any of its contents, without having been previously authorized, from expressly and in writing, by the Chamber. In addition, he undertakes not to carry out any other activity that could infringe the intellectual property rights of the Chamber, collaborators, sponsors or third parties.

The Chamber may prevent the publication of certain content, or remove it from the portal, in the event that it considers that there may be a violation of the law in force, of the rights of third parties, or if it receives any communication in this regard. The indicated withdrawal will not give rise to the perception of compensation of any kind.

REGIME OF RESPONSIBILITY

a) The Chamber declines any kind of responsibility derived from the information published on its website, as long as this information has been manipulated or entered by a third party outside of it.

b) It cannot guarantee that the use made of the website and its services is in accordance with the law, these general conditions, morals and public order; however, it will adopt the measures it considers appropriate at any given time, to comply with what is established in current legislation.

c) It is not responsible for damages of any nature that may arise from the incorrect, illegitimate or illegal use of the website or the contents offered there.

d) The right is reserved to prevent the user from accessing and using the services of its web portals, at any time and without prior notice, in the event of non-compliance with this Legal Notice and in the event of acts contrary to the law, morality, generally accepted good customs, and public order.

e) The right is reserved to modify this legal notice, at any time, respecting the rights acquired by users.

f) Under no circumstances will the Chamber be liable for moral damages, loss of profit and/or any direct or indirect damage that the user may suffer.

g) From the website it is possible to be redirected to third-party content. Given that the Chamber cannot always control the content entered by third parties, on its website, it does not assume any type of responsibility with respect to said content. In any case, any link that could contravene national or international legislation, morals or public order will be removed immediately, with the redirection to the said website immediately removed, informing the competent authorities of the content in question.

h) This website has been reviewed and tested to function properly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the possibility cannot be ruled out that circumstances may arise, such as programming errors, service interruptions to carry out maintenance tasks, or events beyond your control, such as they can be the causes of force majeure, natural disasters, actions of hackers or crackers, strikes, or similar circumstances that make access to the web page impossible.

GENERAL CONDITIONS CLUB CAMBRA

Membership of Club Cambra and the use of any of the related products and services implies acceptance of the conditions set out in these general conditions. For this reason, we recommend that you read the content carefully.

CONDITIONS OF MEMBERSHIP IN THE CAMBRA CLUB

Membership of Club Cambra will allow you, in its various forms, to enjoy discounts or special conditions regarding the contracting of the various products and/or services offered by the corporation.

All those companies that belong to the geographical demarcation legally assigned to the Chamber may belong to the Chamber Club, in any of its forms.

All the services and advantages that membership of Club Cambra entails, as well as its territorial scope of provision, can be consulted on this website consisting, essentially, of the possibility of accessing certain discounts on products or services offered by the chamber

The status of Club Cambra member will remain, indefinitely, as long as the requirements for membership are met, it is not necessary for the member to express his will to renew this status.

TERMS OF MEMBERSHIP IN THE CAMBRA CLUB

RECRUITMENT AND RENEWAL OF THE BASIC CARD

All companies that use or contract any product or service included in the Chamber's catalog automatically acquire the status of Basic Member of the Chamber's Club.

Registration at Club Cambra, as a Basic Member, is free and does not entail the payment of any fee.

This type of membership is identified by means of a green-coloured card, which contains the name of the company and the membership number.

Registration to the Chamber Club will preferably be done using the Chamber's services, or using the form enabled for that purpose on the web, although this request can also be made by any other means that the Chamber deems appropriate.

Once the registration has been completed, the company will receive the card that accredits it as a Basic Member of Club Cambra.

The status of Basic Member of Club Cambra will be maintained indefinitely as long as the requirements for membership are met, it is not necessary for the member to express his wish to renew this status.

RECRUITMENT AND RENEWAL OF THE BUSINESS CARD

The Business Member modality of the Cambra Club entails the payment of an annual fee.

In the event that the holder is a company, it will have to personalize the card. The company must indicate the name and surname of the person who must appear on this card.

The status of Business Member grants exclusive advantages to its holder (company or freelancer), and in the case that the holder is a company, other exclusive advantages for the person named in the card. Essentially, discounts or free of charge on some of the products or services offered by the Chamber.

A company, as the holder of the Soci Business card, can apply for additional cards, paying the corresponding fee.

To sign up as a Business Member of the Chamber Club, the interested party will preferably use the form enabled for that purpose on this website, although this request can also be made by any other means that the Chamber deems appropriate .

Payment for the Business Member card will be made by direct debit to the current account that the member must provide at the time of contracting.

After one year from the date of issue, the Business Partner card will be renewed automatically, unless otherwise indicated by the holder, and the amount of the renewal will be charged to the same current account indicated at the time of the initial request

Failure to pay the corresponding fee will automatically result in the loss of Business Partner status and the right to benefit from the exclusive benefits and services associated with this Business Partner status.

VALIDITY OF THE INFORMATION

The information contained in these pages is current on the date of its last update. The Chamber reserves the right to modify it at any time; in this case, it will come into force from its publication and will be applicable to all Basic Members of Club Cambra from that date, and to Business Members who have accepted it.

The contents of this website, especially the informative and advertising references of Club Cambra, unless expressly stated otherwise, do not constitute any type of binding offer. The Chamber reserves the right to introduce modifications or omit, partially or completely, the current contents relating to the Chamber Club, when it deems it appropriate.

REGIME OF RESPONSIBILITY

The Chamber does not assume any responsibility for the products and services offered by the Partners Club Chamber to Club Members, nor for the level of service they provide. Likewise, the Chamber does not assume any responsibility for the products or services of third parties that are disseminated through advertising banners, newsletters, or publications of the members themselves, within the Club's website.

APPLICABLE LEGISLATION AND JURISDICTION

Any dispute arising in the interpretation or execution of this Legal Notice / Privacy Policy will be interpreted based on Spanish legislation. Likewise, the Chamber and the user, if no regulations prevent it, waive any other jurisdiction and submit to that of the courts and tribunals of the Chamber's domicile for any controversy that may arise. In the event that the user is domiciled outside Spain, the Chamber and the user submit to the courts and tribunals of the city of Barcelona.
